Your Right to Privacy

 

Your right to privacy is very important.  We recognise that when you choose to provide us with information about yourself, you trust us to act responsibly.  We believe this information should only be used to help us provide you with better service.  This privacy statement sets out how Tegel will handle your personal information.

 

In this Privacy Statement ("Statement") when we say “we”, “our”, “us” or “Tegel”, we mean Tegel Foods Limited, together with its related companies and any reference to “you” or “your” refers to you.

 

When we use the term “personal information”, we mean information that is about you or information that could be used to identify you.

 

This Statement applies to personal information we collect through the Tegel website ("Site"), our social media accounts, and in connection with the provision of our products or services, including customer support, promotions, events and surveys. This Statement also applies to personal information we collect from third parties in connection with the provision of our products or services. This Statement does not apply to any personal information we may collect about our employees or contractors.

Acceptance of this Statement

 

When you access, browse, view or use the Site or otherwise provide us with any of your personal information, you accept this Statement and you acknowledge that your personal information will be collected, used and disclosed in accordance with this Statement.

 

We may amend and update this Statement from time to time by posting an updated version of this Statement on the Site. When we update this Statement, we'll revise the "last updated" date at the top of the Statement. The changes will apply from the date that we upload the revised Statement.

 

What personal information do we collect?

 

The personal information we collect depends on the nature of your interaction with us.

 

We may need to collect personal information about you, including when you enquire about our products, engage with our call centre or participate in a promotion or competition.  The personal information that we collect may include your name, phone number, email address, postal or delivery address. 

 

If you are applying to be a business customer, then we may need to collect additional personal information from you or your business' personnel to facilitate that relationship, including in certain circumstances, credit history information.

 

Generally, we will collect personal information directly from you. For example, when you submit an enquiry through our Site, engage with our social media accounts or our call centre.

 

Automatic collections of personal information

 

We may also collect personal information about you automatically when you visit our Site or social media accounts using cookies or similar tracking technology (together "cookies"). For more information about our use of cookies, please see the section headed "se of cookies" below.

 

If you choose not to provide us with your personal information, then we may be unable to provide you with access to some of our products and related services and some functions and features on our Site may not be available to you.

 

Indirect collections of personal information

 

While in most instances, we collect your personal information from you directly, in limited circumstances we may collect personal information about you from other sources, including third parties. Where we collect personal information about you from third parties (for example, third parties working with us to facilitate the services provided on our Site or social media accounts, or in connection with running Tegel competitions or promotions), we will do so in compliance with all applicable privacy laws.

 

As set out above, if you are applying to be a business customer, then we may need to collect information about your credit history from third-party credit reporting agencies. As at the date of this Statement, we collect such information from CreditWorks Data Solutions Ltd. We will use any credit information collected solely for the purposes of assessing your or your business' application.

 

Where you provide us with any personal information about a third party, you must have that third party's consent to do so. By providing us any third party personal information, you warrant that you have that third party's permission to provide that information to us.

 

How we use personal information

 

When we collect personal information about you, we will use that information in accordance with this Statement, including for the following purposes:

 

(a)                to provide you with our products;

(b)               to communicate with you (for example to provide customer support, or correspond with you about orders and deliveries);

(c)                to facilitate your use of the Site;

(d)               if you apply to be a Tegel business customer, to perform credit checks or collect debts that you owe to us;

(e)                to facilitate your participation in any promotion or competition that you have entered;

(f)                 to help us understand your needs, improve our products and conduct market and business analysis; and

(g)                to analyse, aggregate and report analytics for internal purposes;

(h)               to comply with any legal obligations; and

(i)                 any other purpose authorised by you.

 

If you have expressly opted-in to receive promotional or marketing materials, we may send you information about us or our affiliated companies' products and promotions that we think may be of interest to you. If you would prefer not to receive such information, please let us know by emailing unsubscribe@tegel.co.nz. If you do opt out, we may still have to send you operational communications about our products you may have purchased, or where necessary for our compliance with New Zealand laws.

 

Who we may disclose personal information to

 

Personal information that we collect about you will only be disclosed in accordance with this Statement.  We may disclose your personal information to:

 

(a)                our related companies to support the provision of goods and/or services to you or to otherwise create and maintain our databases and business records generally;

(b)               our service providers that we have engaged to provide a service to us in relation to the Site or any product or service that we have agreed to provide you.  For example, we may share personal information with a service provider we have engaged to provide us with customer support services, marketing services, technology services or debt collection services;

(c)                if you are applying to be a Tegel business customer, credit reporting agencies; 

(d)               regulators, law enforcement bodies, government agencies, courts or other third parties where it is necessary to comply with any applicable law or regulation, or to exercise, establish or defend our legal rights;

(e)                an actual or potential buyer (and their agents and advisors) in connection with an actual or proposed purchase, merger or acquisition of any part of our business; and/or

(f)                 any other person or organisation that you have authorised us to disclose your information to.

 

The third parties to whom we disclose your personal information may be located within or outside New Zealand. Where we have to transfer your personal information to any overseas agency, we will do so in accordance with the Privacy Act 2020 and other applicable laws and regulations.

 

Access, correction and retention of your personal information

 

You agree that any information you give us will be accurate, correct and up to date, and that when acting on behalf of a business or another person, you are authorised to give such information to us.

You must inform us if any of your personal information changes, to ensure that the details we hold about you are up to date and correct.

 

You are entitled to request access to the personal information we hold about you, and to request that we amend it if it is incorrect. These rights are subject to certain limitations and exceptions as set out in the Privacy Act 2020.  We may also charge a fee to complete personal information requests.

If you are unsatisfied with the handling of your request, you may contact the Office of the Privacy Commissioner in New Zealand for review of our handling of your request.

 

We will not retain your personal information for longer than is reasonably necessary to fulfil the purposes set out in this Statement. 

 

Use of cookies

 

Our Site uses cookies to store and track information about you when you are on our Site.  A cookie is a small data file that our Site may send to your computer.  Any such cookie is typically stored on your computer's hard drive and permits our Site to recognise you when you return to it.

Our use of cookies helps us to provide you with a better experience during your use of our Site by allowing us to understand what areas of the Site are of interest to you.  These cookies are used for analytics and Site functionality purposes and do not identify you directly, although they may collect technical information such as device or browser data.

We are committed to keeping your personal information as safe and secure as possible and we follow generally accepted industry standards to protect the personal information submitted to us.

 

While we regularly review and update our administrative, technical, and physical security measures to help protect your personal information against unauthorised access, loss, destruction, or alteration, we cannot guarantee the security of the transmission or storage of your personal information.

 

While we will ensure that your personal information is protected by reasonable security safeguards, we cannot guarantee complete security of your information from theft, destruction, or inadvertent disclosure.

Tegel may have links or references to other websites from our Site, and our Statement does not apply to those websites.  Tegel takes no responsibility for the privacy practices of other websites, and we encourage you to review the applicable privacy policies of those third party websites.

 

Residents outside of New Zealand

 

Our Site can be accessed by people all over the world, in different countries with different laws. Other jurisdictions have different laws regarding the collection, storage and use of your personal information.  By visiting our Site and providing us with your personal information, you acknowledge and agree that your personal information may be processed for the purposes set out in this Statement.

 

Privacy breaches

 

If we believe a privacy breach has occurred, we will identify the issue and take steps to minimise the harm. If we believe the breach has caused, or is likely to cause, serious harm we will contact the Office of the Privacy Commissioner and may also contact you if we think you will be affected by the breach.

If you believe a privacy breach has occurred, please contact us as soon as possible.
